You are both right, but this doesn't stop them from writing their essay. It only stops them from writing anything that they can submit. I know, its pretty pointless to write your essay on the planning sheet, then when times starts copy it onto the writing booklet. I guess this is a good idea...

Its probably not too late. But you have a lot of work to do. If you try hard enough and manage to do better you can get the marks you want. Don't give up. :)

Trials usually have a high weighting, and you probably still have other assessments to do. Just try to get your school assessment rank up, as its all determined by the HSC which you are yet to do. So, no.. its not too late.
