Im working on a case and one of the questions i have to answer is the role of dricresion.... problem being is that my teacher is basically making us teach our self the topic...can someone help??? Also does anyone know what i should base my answer on for sentencing issues- process/ penalties/ institutions??? :confused:



any help will be appreciated

Police Discretion - Whether or not police will act on a crime, and if they do how they will act. Eg Underage drinking - may ignore it, may issue a warning/fine or arrest. CIRCUMSTANCE.

Judicial Discretion - Judge determined length of the sentence. Take into account VIS (Victim Impact Statement), Mitigating factors, Aggrivating factors, Past record, Crime, AND the statutes regarding the max + min sentences for a crime.
