Erm, I just did a crapload of multiple choice questions, cept they dont have answers, so um help?

1. Which of the following best describes an example of stare decisis?
a. the right of a parliament to make laws
b. comments made by a judge which are non-binding
c.the ability to bring an action to court
d. the binding section of a judges decision

2. Which of the follwoing best describes the Letters Patent?
a. the establishment of a telecommunications network

3. The theory that suggests laws should be based on the greatest good for the greatest number of people is best described as

1. D (Also known as Doctrine of Precedent)

Stare decisis is a Latin term ("let that stand which has been stated") used in common law to express the notion that prior court decisions must be recognized as precedents, according to case law. It is the Latin term for the 'doctrine of precedent.

2. B (Letters Patent - authority from Britain for the Govenor to make laws etc)

Page 10 of the Heinemann textbook. It was the first law issued for the new colony from Britain.

4. Courts are bound by decisions from higher courts only. For the sake of uniformity they generally follow precedents from the same level. Decisions from the same level or from other jurisdictions are "persuasive" only..
