Who here is doing this subject. I have an assignment due on the 31st of March. Here is the question.

- Consider this statement:
"The Commonwealth Parliament can enact laws on any matter of natioanl importance, overriding state laws. For example, the Commonwealth Parliament could introduce new laws to regulate pollution and waste producing activities carried on by Australian businesses."

Discuss this statement, including appropriate reference to the main principles relating to the division of legislative power in Australia, and briefly apply these principles to the example given above.

I've got a rough idea of what to write, but i would also like to see how other people will approach this essay.

What do you think is the best way to start it?

I'm not a fan of writing essays, and i had to do essays for legal studies for my HSC and i know the stuff we have learnt so far, so it isn't too bad.

aight due.. this is such an easy assignmnet... bascially... explain the division of powers handed to the fed and states from the consititution. disucss what areas of the consitiution outline who has what powers, and who takes care of what areas in making laws.

90% of it is in the text.. however there are a few good books to explore the idea in the library. dont forget to refer to the example they gave you slightyly.. you may want to include certain similar environment examples of where the cmlth has created such laws .

err.. its like... only one of the biggest parts of the assignmnet.. everything you discuss, is really explaining how the seperation of powers effect whats going on, and why fed > state laws, and why there is that seperation, and what difference tat seperation is making

correct me if im wrong - but.. im 99% sure im not :eek:

Separation of powers? Are you sure? Because the question says refer to the DIVISION OF POWER.

I didn't mention anything on SOP. I only referred to DOP.

wtf is the diff bettwen sop and dop? :eek:

i took them to mean the same thing... the assigning powers to Cmth and State via the constitution?

SOP refers to the legislature, executive and judicature.

DOP is what you mean. The exclusive and concurrent powers for the State and Cth.

They're not the same thing.

arent i miss helpful :D

yer few more hundred words and ill get this done toinght i thinks... will be a good test to see how well i go, and how well im getting jist of doing a non-IT course... after studying IT for a few years at uni.. .i forgot how to use a pen... but im loving the new corse... goign well in most of my subjects... economics is my thing i think... got that coming up... hrmm

/me contniues to rattle off..

Interpreting the question is what the job of a person studying the law is. Be careful.
