i used the example of legal aid..
it exists, but it is not available to all.. i used the case of dietrich v. the queen (1992) as the precedent to prove that it is a legal right, however due to a means, merit and jurisdiction test, it may not necessarily be granted to all

institutionalised inequality isn't when 2 people get fined the same ammount regardless of their ability to pay it like the rich and poor man that's formal equality.

What about at a more basic level?

Eg - The right to a fair trial --> isn't neccessarily fair because the judge may be swayed by the quality of the argument rather than the truth, therefore it places low SES at a disadv. and despite legal aid it is too rigid and almost impossible to get?
