I've been reading the NSW Department of Education and Training's, Information for Newly Appointed Teachers, available here. Here are just some of the things which were a bit unusual, interesting, or out of the ordinary. Note that this only applies to NSW Government schools.

NSW Department of Education and Training said:
When confiscating personal items, such as mobile phones or hats, ask students to hand them to you. Only take items directly from students in circumstances where concern exists for the safety of the student or others and your own safety is not jeopardised by this action;
According to this they can only confiscate material if it raises a safety issue.

Poor or unacceptable practice: (this applies for teachers)
NSW Department of Education and Training said:
  • Excluding students from a lesson or activity, then leaving them unsupervised in corridors, classrooms or storerooms;
  • Leaving a class unattended or dismissing students early from a lesson so that they are unsupervised;
  • Attempting to physically prevent a student from entering or leaving a classroom, unless there is a concern for the safety of the student, other students or staff;
  • Pursuing a student who is attempting to run away unless that student is in immediate danger or is likely to harm another person;
  • Shouting angrily at students to intimidate them;
  • Public disciplining or humiliating a student as punishment or as an example to other students;
  • Throwing an object, such as a duster, chalk, ball or book, at a student to get their attention;
  • Threatening students with physical punishment;
  • Corporal punishment, such as hitting, smacking or caning, of students is prohibited;
  • Arranging activities or meetings alone with a student that are not within school guidelines or that are without the informed approval of a supervisor and, if appropriate, the parent or caregiver;
  • Putting your arms around students while instructing them on the computer;
  • Developing a practice of cheek kissing as a greeting or for congratulating students;
  • Allowing a student to sit on your lap;
  • Undressing in front of a student, e.g., in PE or Activity Centre change rooms;
  • Giving gifts or money to students as a reward or incentive for good behaviour or as a gesture of friendship;
  • Telling jokes of a sexual nature;
  • Making sexually suggestive remarks or actions, obscene gestures or showing inappropriate videos;
Wow, so many things are poor or unacceptable practice, but I have witnessed about 90% of these things, in a public school!

can u sue them for breaching it, can we dl from net? i wanna show that to my english teacher at parent-teacher interview...lol

No, they can only take it from a student if it poses a safety threat.



If it does not pose a threat then the teacher can only ask that the student hand it over.

I'm not a lawyer, but I don't think you can sue them. Not sure though. And I should have acknowledged my source, I think it was, https://www.det.nsw.edu.au/employment/recruit/casualteachers/profrespons.htm

A teacher can only directly take the item if there is a safety issue. They can indirectly confiscate material (i.e ask the student to hand them the item) at any time.

Basically what it is emphasising is to ask the student to hand you an item that is being confiscated, as opposed to taking it, unless there is a safety issue.
So why don't students say "No, I'm not going to give you this.", what if they refuse to hand an item over requested by a member of staff?

You can refuse a teacher anything, if you don't mind a sanction or detention or whatever for uncooperative behaviour. You raise the teacher's blood pressure, waste some class time, be a hero or a jerk depending on the teacher's cred.

If you whinge about it, you look stupid.

What is cheating in HSC assessment?

Cheating, or malpractice, is dishonest behaviour by a student that gives them an unfair advantage over others. Most students understand what cheating in an examination means, but there are other types of behaviour that are also considered cheating.

Here are some examples of behaviour considered to be cheating:

* copying, buying, stealing or borrowing someone else's work in part or in whole, and presenting it as your own
* using material directly from books, journals, CDs or the internet without acknowledging the source
* submitting work that contains a large contribution from another person, such as a parent, coach or subject expert, that is not acknowledged
* paying someone to write or prepare material that is associated with a task, such as process diaries, logs and journals.

The examples above are generally referred to as plagiarism.
What is plagiarism?

Plagiarism is when you pretend that you have written or created a piece of work that someone else originated. It is cheating, it is dishonest, and it will jeopardise your HSC exam results. The following are common questions about plagiarism.

Q Is it plagiarism if I copy someone else's work exactly and claim it is my own work?
A Definitely yes!
Q Is it plagiarism if I change some of the words or the order of sentences in the passage I am copying?
A Yes. You are using someone else's thoughts and words without acknowledgement.
Q Is it plagiarism if someone else proofreads my written work and changes my final draft?
A It is not plagiarism to have someone correct your spelling and grammar. However, if a parent or tutor or anyone else makes major changes to the wording of your draft, the final version is no longer your own work.
Q Is it plagiarism if I get ideas from my reading and research and use them to support and develop my own ideas, but acknowledge the original source in the work I hand in?
A No, this is not plagiarism. You have acknowledged where your ideas came from. It is legitimate to build on ideas from others provided you don't claim they are your own.
Q Is it plagiarism if I quote from a source and indicate this using quotation marks, footnotes or in other ways, and then acknowledge the source in my text and/or in my bibliography?
A This is not plagiarism. You have taken steps to show you are presenting another's words or ideas.

-Leaving a class unattended or dismissing students early from a lesson so that they are unsupervised; [HAHA we used to have the most clueless english teacher.. she used to leave the classroom, all flustered, claiming to be 'photocopying stimulus material' at the start of the period. she would then return with the bell that signalled period's end. esh up much?]
-Attempting to physically prevent a student from entering or leaving a classroom, unless there is a concern for the safety of the student, other students or staff; [this is borderline. never happened in my experience]
-Pursuing a student who is attempting to run away unless that student is in immediate danger or is likely to harm another person; [lol not yet]
-Shouting angrily at students to intimidate them; [it doesn't work anymore.. used to happen in year 7]
-Public disciplining or humiliating a student as punishment or as an example to other students; [happens.. except role reversals with subs]

-Telling jokes of a sexual nature; [to be honest, this happens frequently when you're a senior. although teachers will never 'initiate' these strings of dirty jokes, if they chance upon two students discussing something saucy.. they will often share their knowledge]
-Making sexually suggestive remarks or actions, obscene gestures or showing inappropriate videos; [ancient history teachers that show us porn on greek jars? the awkwardness is priceless]

Just to keep you happy refer to this DET Policy regarding curriculum planning and programming which basically outlines how you have to refer to Board of Studies documents.
notice the assessment section never mentions anything about plagarism.

Schools plan curriculum and develop teaching programs which are consistent with the Education Act and Board of Studies syllabuses and credentialing requirements.
this is to do with curriculum and teaching programs.. they are just saying they teach what the board prescribes.. they are not saying anything about the policies that implement.

yeh, they killed my account at the end of last year..

But i never said they don't have policies.. i just found it hard to believe without actually seeing them..

holy cow, so you can't send someone out from the class? or give little kids lollies after story time and stuff? that's weird.

i know teachers from my high who have broken pretty much all of the above, and i am quite certain of it.
