hey im in the same boat as you joe, only one exam left - legal tomorrow.

public order offences are summary offences such as offensive language, offensive conduct (i.e. being drunk in public), obstructing traffic, etc. punishments for these are usually a fine or a warning.

Okay, define the role of legal aid.

legal aid is to suppy legal advice to thsoe who need it, therefore one has the right to 15 mins of legal advice if so one chooses.

to obtain legal representation, one must pass the jurisdiction test, merits test and means test.

the jurisdiction test determines whether it would be profitable to help you're case. they usually help youths.
merits test, is the possibility of the case succeeding in the favour of the Department of Public Prosecutions (DPP).
the means test, whether the accused has the monetary terms to afford legal representation themselves.

however, legal aid is not a given as seen in the case, McInnis v R (1979). however, everyone has the right to a fair trial, which is present in the case, Deitrich v R (1992).

yes i did have all of this inmy head, except i had to check the dates of those cases in the latter part in this post. :D

edit: how is the legal system affected, and by what factors?

discretions can also lead to biasness to be had. especially on the part of the police personnel. their discretion could be led to people saying that they are disriminating

Mitigating factors are those factors brought up during sentencing as opposed to defences which are raised during the trial????

anyway strict liability is where mens rea doesnt need 2 be proved
only actus reus

strict liability is when one does not need to be proven to have mens rea to determine guilt. its something that is already known, such as the obtaining of a driving license.

answer my first question, that was in my half yearly!!

or else answer this. if a person was charged with any kind of sexual assault, in which court would they appear in first. and since that was such as easy question, the second is; in which coourt would i appear, for sedition?

!st question - local court for a commital hearing here the prosc must establish a prioma facie case
2nd question...4 sedition u would need to be taken to supreme court...wait or is it hiugh court???

What are the two types of preliminary offences ? give exmaples

1st q - i would say district, local if you ocunt committal hearing
2nd q - supreme

im using the defence of provocation
i was provoked after melsc threatened 2 steal my pants

two preliminary offences are:
conspiracy
attempt :D

edit: now she wants jagos pants
