are you joking? question 9? legal representation is NOT guaranteed by the constitution. in the Dietrich 1992 case it was only determined that there was a right to legal representation for serious criminal matters. also, do you have a view on question 11?

    Section 1 - Law & Society

if you google "right to silence" the first thing that comes up is "The right to remain silent, as it is officially called, is a legal right of any person subjected to police interrogation or summoned to go to trial in a court of law" however, the right to remain silent is also protected by the...

    Section 1 - Law & Society

how can you argue that the local court is MORE enforceable if its jurisdiction doesnt even cover discrimination? this is a question of enforcing Brian's RIGHTS and not the LAW anyway

    Section 1 - Law & Society

if discrimination is under the local court's jurisdiction than it will be more enforceable. obviously, if its not under the local court's jurisdiction, it cannot enforce anything. however, the commision can conduct conciliation, which is, at least, more enforceable than a court that cannot make...

    Section 1 - Law & Society

iv gone through heaps of legislation and from what i can gather the local court does not have the power to make determinations with regards to discrimination. the anti discrimination act 1977 specifically states that the local court where here determinations in "summary" and will not directly...

    Section 1 - Law & Society

can I ask why you think 11 is not d? I personally wrote c but I thought I was wrong. isn't the act of the nsw parliament passing a law evidnce of it using powers outlined in the constitution? I could be wrong. this question took me ages to do coz I was like "since when can the nsw GOVERNMENT...

    Section 1 - Law & Society

from hreoc's website: "We help resolve complaints about human rights violation & various discrimination laws through a conciliation..." but in terms of enforceability the local court would be better if it had the jurisdiction to cover discrimination, as conciliation doesn't get you anywhere
  12. J

    Section 1 - Law & Society

isn't it like general knowledge that statute law can override common law? a prima facie case doesn't enforce any rights, it just determines whether or not there was enough evidence for the case to be heard in a higher court. but I guess the question does say "which of the following is BEST...

    Section 1 - Law & Society

since when does the local court have a jurisdiction over discrimination matters? that was a stupid question. I had D for 14 but I didn't think any of them were really that correct :/

    General Thoughts: Mathematics Ext 2

It was relatively easy. There seemed to be alot more questions worth 1 and 2 marks than normal idk. I ran outta time.
