of course he was charged; the more pertinent question is whether or not he will be convicted
why should he be charged?

the crimes act is very clear on this

the intruders were armed and he disarmed and shot one in the leg in the process

even if this was drug related it should have ZERO bearing on the police prosecution fuck what a disturbing precedent

hey we're charging your for manslaughter after you shot this guy with his own gun whilst he was trying to murder you because you have an outstanding parking fine

Risky topic. I think it'll be interesting to see whether it's justifiable to 'defend' your property rather than a defense of your own life at risk (although the man may have perceived the intruders to be threatening his life also).

I'm on the fence with this one.

If someone is in your house, with a gun, they're fair game. That gun shows intent to harm you, he's not just in there to have a look around or steal your ipod.

just a question, if say some1 is trying to mug you but you end up beating them unconscious, but instead of stopping there you continue to beat them to death would it still be self-defence?
