The focus of the Children and Young Persons (Care and Protection) Act 1998 (NSW) legislation is to ultimately safeguard the health and wellbeing of children. This includes protecting them from violence and/or abuse. In addition to this, this legislation also covers the circumstances and living conditions in juvenile detention centres.
This legislation also covers Mandatory Reporting and reports of concerns to Community Services. Individuals such as teachers, doctors, nurses and other professionals are legally obligated to report an issue if they believe there is a detrimental risk of harm due to potential family violence or abuse. All individuals that work with children are mandatory reporters.
The law was ultimately reformed in order to improve early intervention services, introduce parental capacity orders, and enable adopted children to maintain a connection with their biological parents.
