With essay questions that along those ^ lines such as "Assess the use of defences to criminal charges in achieving justice" what would i need to talk about? would i need to use the effectiveness criteria? or is there some sort of assessing justice criteria?

Just talk about what they're addressing (it's usually more broader than that since trials/half yearlies use one of the 6 Crime subheadings excluding the first one).

Yes you do need to use the effectiveness criteria.

If it's an 'assess' question, using the citeria is the safest way to go. And you'd need to talk about the positives and negatives of the legislation/common law/etc.
Also, use cases and media reports, they convey society's opinion and as a result show whether or not justice has been achieved.
